TO THE FULL EXTENT PERMITTED BY LAW, (1) NO ARBITRATION OR PROCEEDING SHALL BE JOINED WITH ANY OTHER; (2) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS-ACTION BASIS OR TO UTILIZE CLASS ACTION PROCEDURES; AND (3) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR ANY OTHER PERSONS.
Either party may seek equitable relief in a court of competent jurisdiction for matters involving intellectual property rights or unauthorized access to our services.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of our services.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and magery.com regarding your use of our services and supersede all prior agreements and understandings.
